Dear "Sir,"
We are the upstream provider for the person who used to host the web
site in question. We have no control over his computers or what he
decides to publish with them.
We are also a business based in Phoenix Arizona and our AUP binds our
customers to Arizona law:
See paragraph 18:
"This Agreement shall be governed by the laws of the State of
Arizona. Any legal dispute shall be submitted to Binding Arbitration
within the Confines of the Phoenix Metropolitan area, Maricopa County
Arizona, under the rules of the American Arbitration Association. Any
disputes must be filed within one year of the occurrence or FastQ and
User both agree that the action shall not lie."
Also please note, FastQ acts as a common carrier under US law. We
have no control over what a downstream user does as long as it does
not violate US copyright law or other applicable laws. We notified
the user yesterday that there was content on his web site that
objectionable to you and requested he comply by removing the material
in question from services provided by us. We did not "order" him to
remove it. He did it on his own accord.
The UK law of defamation is not applicable to us as we have no
operations in the UK, do not "host" the web site in question, and see
no violation of any US law by the user in question.
Note your own quote of our AUP:
"...FastQ shall in good faith be the sole arbiter of material content
in these regards."
If you provide us with a valid US court order to remove this user
from our systems we will comply.
Other than that, we are unable to remove the user's account because
there is no violation of US laws.
Feel free to submit evidence to us otherwise and we will be glad to
evaluate it.
